1. About these terms
These terms and conditions apply to all services provided by ASTER Media, ABN 73 248 063 074 (“ASTER Media”, “we”, “us”) to you (“the client”). By accepting a quote, paying a deposit or invoice, or asking us to start work, you agree to these terms.
If your written quote or agreement says something different, the quote or agreement applies.
2. Our approach and what we can't promise
Digital marketing is changeable. Platforms update their algorithms, ad auctions shift, search results move and audiences change, often without warning. Because of that, we don't promise overnight results, viral content, guaranteed rankings or a set number of views, followers, enquiries or sales.
What we do promise is to apply our years of industry knowledge, skills and services to your business to drive positive, sustainable growth. We focus on steady, long-term improvement rather than quick wins that don't last.
Results depend on many factors outside our control, including your market, competition, budget, ad spend, offer, pricing, timing, how quickly you respond to enquiries and the policies of third-party platforms. All services are provided on a best-efforts basis.
3. Quotes and pricing
Prices on our website are starting prices in Australian dollars. Final pricing depends on the scope of work, including deliverables, complexity, timeframes, locations and travel. We'll give you a written quote before any work begins. Quotes are valid for 30 days.
Work outside the agreed scope, extra revisions or changes after approval are quoted separately before we do them. Additional work is charged at $95 per hour unless otherwise quoted.
ASTER Media is not currently registered for GST, so GST is not charged on our invoices. If we register for GST in future, we'll give you notice and GST will be added to invoices from that date.
4. Deposits
All deposits are non-refundable. A deposit secures your booking and confirms your commitment to the project, and it is deducted from your final invoice.
Photography and video shoots require a $150 deposit. Larger projects may require a higher deposit, as set out in your quote. A shoot can be rescheduled once with at least 48 hours' notice, and the deposit carries over to the new date. Cancellations, no-shows or reschedules with less notice forfeit the deposit.
5. Payment
Invoices are due within 14 days unless otherwise agreed in writing. Retainers and monthly packages are invoiced monthly in advance.
We may pause work on accounts that are overdue. Your licence to use deliverables (see section 10) begins once the relevant invoice has been paid in full.
6. Retainers and monthly packages
Ongoing services, including content packages, SEO packages, advertising management, retention marketing and done-for-you support, start with a three-month initial term. After that, they continue month to month until either party gives 30 days' written notice.
Monthly deliverables are planned for that month. Unused deliverables don't roll over to the next month unless we agree in writing, for example where a delay was caused by us.
7. Shoots, edits and revisions
A half day is up to 6 hours and a full day is more than 6 hours. Basic edits are included and capped as set out in your quote or package. Basic edits cover colour and exposure correction, cropping, light retouching, simple video cuts, captions and licensed music.
Advanced retouching, compositing, colour grading, motion graphics, extra deliverables and additional revision rounds are quoted separately. Each package or quote includes the number of revision rounds listed.
If weather, safety or access issues prevent a shoot, we'll work with you to reschedule without penalty where the issue is outside both parties' control.
8. Advertising and ad spend
Advertising spend is paid directly by you to the platforms, such as Meta, Google and TikTok, and is separate from our fees. We won't exceed the ad spend agreed with you without your prior written approval.
Ad platforms review and may reject, limit or remove ads, or restrict accounts, under their own policies. These decisions are outside our control, though we'll always work to resolve them.
9. Your responsibilities
You're responsible for the accuracy of all information, claims, prices and offers you give us to publish or promote, and for making sure your products, services and promotions comply with the law.
You confirm that you own or have permission to use any materials you supply, such as logos, photos, footage, music and customer data. Timelines depend on you providing access, information, feedback and approvals on time; delays on your side may move delivery dates.
10. Content, intellectual property and usage
Once paid in full, you receive a non-exclusive, perpetual licence to use the final deliverables we create for your business across your own channels, website and advertising. ASTER Media retains copyright in raw files, footage and working files unless we agree in writing to transfer it. For brand identity projects, copyright in the final logo and identity files transfers to you once paid in full.
We may show work we've created for you in our portfolio, website and social media unless you ask us not to in writing. Strategies, templates and processes we've developed remain our intellectual property.
11. Third-party platforms and tools
Our work often relies on third-party platforms and tools such as Meta, Google, TikTok, Klaviyo, Shopify and website hosts. We aren't responsible for their outages, policy or pricing changes, algorithm updates or data issues. Where we manage accounts for you, they should be owned by your business, and we'll hand back access when our work ends.
12. Editorial independence
ASTER Media also publishes GOOD DAMAGE. Paying for ASTER Media services never buys editorial coverage in GOOD DAMAGE, and any paid placement in GOOD DAMAGE is clearly labelled.
13. Right to decline
We may decline or stop work on content or campaigns that we reasonably believe are unlawful, misleading, harmful, or in breach of platform policies or our values.
14. Confidentiality
We keep your business information, data and account access confidential and use them only to deliver our services. Contractors who work on your account are bound by the same obligations.
15. Ending our work together
Either party may end a project or service by written notice, subject to any minimum term and notice period above. You must pay for work completed and costs committed up to the end date. Deposits and fees for work already done are non-refundable.
16. Liability
To the extent permitted by law, our total liability for any claim relating to our services is limited to the fees you paid us in the three months before the claim. We're not liable for indirect or consequential loss, such as lost profits or lost opportunities.
Nothing in these terms excludes, restricts or modifies any rights you have under the Australian Consumer Law that can't be excluded.
17. Disputes
If a dispute arises, we'll first try to resolve it in good faith by talking it through. If that doesn't work, either party may refer it to mediation before starting court proceedings. These terms are governed by the laws of Queensland, Australia.
18. Referral program
When a business you refer becomes a new client and pays its first invoice of $500 or more, you receive a $100 credit on your next invoice and they receive $100 off their first invoice. Credits have no cash value, can't be transferred, and are issued once per new client. We may change or end the program at any time; referrals made before a change are honoured.
19. Changes to these terms
We may update these terms from time to time. The version on our website at the time you accept a quote applies to that work.
